Allen County prosecutors formally charged Paul L. Bell Jr., 28, Wednesday with one felony count of rape and one felony count of sexual battery.
In July, a woman told police she had gone to a house party and spent the night at the host’s home after having four drinks. At some point, another person got into bed with the woman and began kissing her, she said in Allen Superior Court documents.
She assumed this person was an ex-boyfriend, court documents said.
This person then began making advances and had sex with her, she said.
At some point, another person came into the room and had a brief conversation with the man in the bed with the woman.
It was then that the woman said she knew the man was not her ex-boyfriend but Bell. She told police she tried to push Bell off but he became dead weight, according to court documents.
She immediately ran from the house, went to an emergency room and contacted police, according to court documents.
Bell met with police without a lawyer and told police the woman invited him into bed and began kissing him.
After having a brief talk with the person who popped their head into the room, Bell claims he asked the woman whether she knew who he was.
When she mentioned her ex’s name, Bell claims the mood was broken and he rolled over to go to sleep.
Bell allowed police to take samples of his DNA for comparison.
Several months later, a test showed that DNA recovered from the woman matched Bell’s, court records said.
In court documents, Bell remembered kissing the woman but had no memory of having sex with her.
A warrant has been issued for Bell’s arrest.
