60-year sentence in Indiana slaying

RICHMOND, Ind. – An eastern Indiana judge who sentenced a man to 60 years in prison for fatally shooting a woman told the man he deserved the sentence in part because of his lack of remorse.

Wayne Circuit Judge David Kolger also told Jason D. Swallow that his frequent use of a derogatory term to describe his 23-year-old victim, Elisha Kuss Powell, showed his character.

Kolger told Swallow during Tuesday’s hearing that he had treated Powell “like garbage.”

The Palladium-Item reported ( ) that Swallow was convicted of Powell’s murder last month. He plans to appeal his sentence.

Powell, a mother of three, was fatally shot in April 2012 in the house she and Swallow shared in Richmond.
