WARSAW – A 15-year-old boy has offered to plead guilty to conspiracy to commit murder in the shooting death of his stepfather if prosecutors drop charges of murder and aiding murder.
Kosciusko Circuit Court Judge Rex Reed will decide Sept. 27 whether to accept the plea agreement. If Reed accepts the deal, Colt Lundy could face 20 to 50 years in prison.
The boy and his 12-year-old friend, Paul Gingerich, are accused of shooting Lundys stepfather, 49-year-old Phillip Danner, in April at his Cromwell home.
Lundy testified Wednesday he and his friend were at a park when they came up with the plan to kill Danner and run away.
The teenager said he went in the house first, then let his friend in through an open window in a bedroom where the older boy had two loaded guns waiting. The boys then went into the living room and waited for Danner.
Lundy said they both shot Danner. Authorities said Danner was shot once in the eye, once in the wrist and twice in the chest.
Messages seeking comment were left Thursday for Prosecutor Steven Hearn and defense attorney David Kolbe.
Sheriffs Detective Jonathan Tyler testified in April the boys and two of their friends, who didnt take part in the slaying, plotted for at least a month to kill Danner, so they could run off to Arizona. Prosecutors previously said the boys planned to flee in Danners Dodge Neon. They were picked up at a Walmart in Peru, Ill., about 200 miles away, early the next day.
Lundy and Gingerich were originally to stand trial together as adults Oct. 5. The trial is scheduled to last through Oct. 15. Gingerich faces a murder charge.
Another 12-year-old boy, Chase Williams of Cromwell, was sentenced in May to remain in the juvenile detention center in South Bend until age 18 for his role in the killing. He had been charged as a juvenile with assisting a criminal.
